下面是笔者关于ChatGPT是否会颠覆知识产权(专利)行业的两点看法(作为笔者计划陆续推出的ChatGPT速评之一):

1、ChatGPT会颠覆知识产权行业吗?

ChatGTP可以为知识产权行业的某些场景赋能,至于赋能有多么强力,要看ChatGPT的技术到底有多么智能,以及应用者在何种场景、如何训练ChatGPT。

举几个专利领域的例子:

第一、是已经有人讨论过的使用ChatGPT写专利的场景。我个人认为,ChatGPT肯定可以用于写专利,但是,如果借用现在的高价值专利这一热词,作者持高度怀疑和谨慎观点。对于写专利,将ChatGPT视为现有的“编专利软件或平台”的高级升级版,并无不妥,因为真正的高价值专利,需要考虑的前台后台因素实在是太多,而且很多是不确定、甚至是未知的!(The name of the game is Claim.)

第二、ChatGPT对于专利挖掘可以提供帮助。相比于很多搜索以及交互算法和技术,ChatGPT肯定具有技术层面的极大改进,这一点,归结到底,其实就是信息(现有技术)的搜索和消化能力,这一能力,对于专利(创新点)挖掘显然具有最直接的帮助。此外,如果我们将这一点稍微扩展一下,就可以看到ChatGPT能够为技术研发带来的帮助。

第三、如果能够理解ChatGPT在专利挖掘领域的应用,那么,对于专利人士而言,ChatGPT在专利纠纷处理(尤其是专利无效)领域的应用则应当是顺其自然就可以想到的。

第四、继续关联性延伸,ChatGPT应该可以在专利维权领域起到作用,例如发现侵权。

第五、其他本质上是专利信息/情报利用的应用场景,例如专利分析、导航、评议、FTO等,ChatGPT都可以提供效率提升、成本节约视角的有益帮助。

小结一下,笔者认为,在专利撰写领域,不能太过倚赖ChatGPT提供赋能作用外,在专利挖掘、专利无效和发现侵权等领域ChatGPT应该能提供较大增幅的赋能提升,在专利分析、导航、评议、FTO以及等价值评估、交易设计与谈判等领域,ChatGPT应该可以提供效率提升、成本节约视角的有益帮助,但取决于具体的需求场景,同样不能过分倚赖ChatGPT的输出结果。

如果没有下面的事情发生,笔者认为,ChatGPT是不会颠覆(覆灭)知识产权(专利)行业的!

2、ChatGPT可以颠覆知识产权(专利)行业!

持续了两三年的AI是否可以作为发明人的争议,显然仅仅是限制了人们的想象,AI对于专利行业的挑战,仅被限制在现有专利制度的框架下,AI做出的发明创造该如何被认定的小范围内(AI是否可以作为发明人,仅此而已)。

作者认为,如果现有的专利制度框架不做出重大乃至本质性改变,那么ChatGPT完全有颠覆或覆灭专利行业的可能,怎么做到?其实很简单,就是让世界上不存在符合专利授权条件的发明创造 - 由于新颖性、创造性问题,导致无法被授权。

试想一下,ChatGPT是可以永不停歇的、持续产出覆盖任何技术领域的现有技术(Prior Arts)的,如果这些现有技术都成为公众可以获悉的(Publicly Available),那么还有哪个发明创造可以获得授权呢?

这就是ChatGPT可以直接导致专利行业颠覆、覆灭的地方!

现在还没有发生,是因为ChatGPT还没有被“操纵”用于该目的!(暂时点到此为此,更多内容不再展开...可以从多个维度观察、讨论与决策)
